Understanding the Context
While the FTC has long history of providing guidance on advertising substantiation, through both litigated cases and policy statements, many sellers continue to make unsubstantiated claims about their products and false claims about the proof they have. The Commission also filed false advertising charges against the marketers of Your Baby Can Read!, a program that promised to teach infants and babies to read. The agency settled with the company making the claims and its former CEO, and is litigating its case against the creator of the program. The FTC enforces these truth-in-advertising laws, and it applies the same standards no matter where an ad appears – in newspapers and magazines, online, in the mail, or on billboards or buses.
